Head-of-Household Filing Status
This filing status is better than filing as single because you get a larger standard deduction and tax brackets are more favorable.
Head of household is the most difficult filing status to understand. If you are not married, but pay for the upkeep of a home where a relative lives or you support your parents, you may qualify for head of household status.
You qualify as a head of household if you pay more than half the cost of keeping up a home where you and one or more of your dependents lives, and you are unmarried. A dependent parent does not have to live with you. However, you must pay for more than half the cost of maintaining the home where the parent does live for the entire year. This home can be a rest home or home for the elderly. You must maintain records to verify you pay these expenses.
Any other dependent must live with you at least half of the tax year. The home need not be your principle residence. A dependent is a person for whom you can claim a dependency exemption on your tax. Qualifying children include any child under 19 year's old or 24 year old if they are a full time student. Qualifying relative have no age limit and limited bloodline requirements such as the spouse of your children, parents, or siblings. They must earn less than $3300 per year and you must provide more than 50% of their support.
The past rule, a single parent qualified as a head of household as long as they paid more than half the cost of maintaining the home where the child live does not apply if the child does not qualify as the parent's dependent. You can qualify for head of household if you are married and you do not file a joint return with you spouse, your spouse was not a member of your household during the last six months of the year, and a qualifying child lived in your home for over half the year and you paid for over half of their up keep.
You do not need your spouse's permission to file as head of household. This filing status is better than filing as single because you get a larger standard deduction and tax brackets are more favorable.
